Terms of Service

General Terms and Conditions

By booking photography or videography services with Mason Jean Photography, also referred to as Mase Media, you agree to the following terms and conditions. Please read them carefully before making your booking.

Booking and Payment Terms

  • A non-refundable retainer fee of 50% OR $50.00 is required to secure your booking. The retainer is due at the time of booking, and the remaining balance is due on or before the day of the session/event.

  • Payments can be made via Venmo, PayPal, cash, or check. Payment details will be provided upon booking.

  • Failure to make full payment by the due date may result in the cancellation of your booking.

  • If payment is not received by the due date, a late fee of $50 per day will apply. The Photographer reserves the right to withhold image delivery until full payment is made.

Cancellation and Rescheduling Policy

  • The non-refundable retainer is not refundable if the Client decides to cancel.

  • Cancellations made at least 7 days prior to the event will receive a partial refund of any payments made beyond the retainer.Cancellations made 48-24 hours before the session/event will result in the full payment being due.

  • Cancellations made 48-24 hours before the session or event will require full payment.

  • In rare cases where Mason Jean Photography is unable to attend due to illness or emergency, a full refund will be issued, or an alternative date will be offered.

  • If the Client cancels or postpones the event, the retainer is non-refundable. If the Photographer is unavailable for a rescheduled date, the retainer remains non-refundable. However, if the Photographer is available, the retainer can be applied to the new date.

Late Arrival and Session Cancellation

  • If the Client is more than 15 minutes late to the scheduled session or event, Mason Jean Photography reserves the right to cancel the session and the full payment for the session will remain due and non-refundable.

  • Mason Jean Photography shall not be held responsible for any missed time or services resulting from the Client’s late arrival.

Client Responsibilities

  • Clients must provide accurate information (event details, location, contact information) at the time of booking. It is the Client’s responsibility to communicate any changes to the event details as soon as possible.

  • Clients must ensure that all locations and persons involved in the session are available and ready as per the agreed-upon timeline.

Liability & Safe Working Environment

  • Mason Jean Photography is not liable for any injury, loss, or damage to property or persons occurring during the session/event. Mason Jean Photography is only liable for services completed and provided by the Photographer and cannot be held liable for the services of other contracted vendors.

  • The Client agrees to provide a safe working environment. If Mason Jean Photography feels unsafe due to harassment, threatening behavior, or unsuitable conditions, they reserve the right to leave, and no refund will be issued.

  • If unforeseen circumstances prevent the Photographer from working (such as illness, injury, or extreme weather), every effort will be made to secure a suitable replacement. If no replacement can be found, the Photographer’s liability is limited to refunding all payments made.

  • Mason Jean Photography exercises the utmost care regarding exposure, transportation, and photo/video processing. However, in the rare event that photos or videos are lost, stolen, or destroyed for reasons within or beyond Mason Jean Photography's control, liability is limited to refunding all payments received. In cases of a partial loss of original footage, liability will be calculated based on the percentage of total images lost.

Copyright, Usage & Model Release

  • The Client may not edit, alter, or crop the final images in any way, including applying filters or making any modifications that misrepresent Mason Jean Photography’s original work.

  • All images and videos taken by Mason Jean Photography remain the copyright of the Photographer. Mason Jean Photography reserves the right to use images for promotional purposes, including but not limited to social media, portfolio, and advertising.

  • Clients are granted a personal usage license to print, share, and use images for personal purposes only. Any commercial use must be agreed upon in writing.

  • If you wish to opt-out of public use, this must be communicated before the event, and a formal agreement can be made.

Overtime

  • Additional unplanned and/or uncontracted services, such as event delays, extensions of time, or services outside the original agreement, will be billed at $250 per hour with prior notification and consent.

House Rules

  • Mason Jean Photography will adhere to all location rules and facility staff instructions regarding camera setup. The Client must accept any technical limitations resulting from these regulations.

  • Mason Jean Photography will not photograph during inclement weather that could damage equipment. If weather conditions prevent photography and no indoor alternatives are made, the retainer and payments made are non-refundable.

  • Mason Jean Photography’s operations are subject to the regulations imposed by the event or location site. The Client consents to accept the technical outcomes resulting from these regulations. Any adjustments to these guidelines must be negotiated by the Client.

  • Mason Jean Photography will not be held liable for the absence of specific shots due to these rules, directions, or interference by guests or vendors.

Delivery and Turnaround Time

  • Final images/videos will be delivered within 2-3 weeks for portrait sessions and 6-8 weeks for weddings and large events, unless otherwise agreed upon.

  • Deliverables will be provided via an online gallery or other means agreed upon during booking.

Travel and Accommodation

  • Travel fees will apply for sessions located more than 30 miles from Mason Jean Photography’s base. Travel fees will be calculated based on distance, gas, parking, and other necessary travel-related expenses.

  • For events that require overnight stays, the Client is responsible for the cost of accommodations, including hotel stays and any associated fees. These costs will be outlined prior to booking, and the Client will be notified of any applicable travel expenses before confirming the booking.

Dispute Resolution

  • Any disputes arising from these terms and conditions will be addressed through mediation or arbitration, based on the agreement between the Photographer and Client.

Changes to Terms and Conditions

  • Mason Jean Photography reserves the right to update or modify these terms and conditions at any time. Clients will be notified of any significant changes prior to their event.

  • By booking with Mason Jean Photography, you acknowledge that you have read, understood, and agree to these terms and conditions.
